Purchase Agreement (Terms of Sale)

By placing an order on this site, you agree to these Terms of Sale. If you do not agree, do not purchase.

1) Definitions

• "We" / "Us" means SergeantFuzzy.dev.
• "You" means the purchaser or licensee.
• "Products" means digital goods such as plugins, documentation, configurations, and related assets.
• "License" means the limited rights granted to use Products pursuant to these terms or a specific license file.

2) Eligibility

You must have the legal authority to enter into this agreement and be in a jurisdiction where our Products and Stripe-powered payments are permitted.

3) Products & Licensing

All Products are licensed, not sold. Unless stated otherwise, licenses are non-exclusive, non-transferable, and intended for the purchaser's own use on their servers/projects. Redistribution, resale, or public sharing of binaries or license keys is prohibited.

Each Product may include its own license file/terms (e.g., a plugin EULA). If there is a conflict, the specific Product license governs.

4) Pricing & Taxes

Prices are shown in USD unless stated otherwise and may change at any time before purchase. Applicable taxes, VAT/GST, and fees are calculated by the payment processor where required.

5) Orders & Checkout

• You must review your order details before checkout. By clicking Pay or similar, you submit an offer to purchase under these terms.
• We may accept or decline any order (e.g., suspected fraud, policy violations).
• During checkout you will be asked to acknowledge this Purchase Agreement and our Privacy Policy.

6) Payment Processing

Payments are securely processed by third parties (e.g., Stripe). We do not store full card details on our servers. Your use of a payment method may also be subject to the processor’s terms and privacy policy.

7) Delivery & Access (Digital Goods)

• After successful payment, you’ll receive access to downloads or license keys. Delivery may be via secure, signed URLs or your account area.
• Links may be time-limited and device/IP checked for security. Keep your links and keys private.
• We may update, replace, or remove download files (e.g., fixing issues, security updates).

8) Refunds

Because Products are digital and immediately usable, all sales are generally final. If you encounter a critical defect we cannot reasonably remedy, contact us within 7 days of purchase at contact@sergeantfuzzy.dev and we’ll evaluate good‑faith solutions (e.g., fix, replacement, or discretionary refund).

9) Chargebacks

Unauthorized chargebacks may lead to license revocation and account access restrictions. Please contact us first so we can help resolve billing issues quickly.

10) Updates & Support

• We aim to provide updates and security patches for actively maintained Products.
• Support scope and response times are best‑effort unless a separate support plan specifies otherwise.
• Backwards compatibility is not guaranteed; release notes will call out breaking changes when feasible.

11) Prohibited Uses

• Reverse engineering, decompiling, or attempting to derive source where not permitted.
• Resale, sublicensing, or redistribution of binaries, keys, or private builds.
• Using Products to violate laws or platform terms (e.g., Mojang/Microsoft, Discord).

12) Warranties & Disclaimers

Products are provided “as is” and “as available” without warranties of any kind. To the maximum extent allowed by law, we disclaim implied warranties of merchantability, fitness for a particular purpose, and non‑infringement.

13) Limitation of Liability

To the maximum extent permitted by law, we will not be liable for indirect, incidental, special, consequential, or punitive damages, or lost profits, even if advised of the possibility. Our total liability for any claim related to a purchase will not exceed the amount you paid for the applicable Product.

14) Indemnification

You agree to defend, indemnify, and hold harmless SergeantFuzzy.dev from claims arising out of your misuse of the Products or violation of these terms.

15) Governing Law & Disputes

These terms are governed by the laws of Michigan, USA, without regard to conflicts of laws principles. Disputes will be brought in the state or federal courts located in Macomb County, Michigan, and you consent to their jurisdiction and venue.

16) Changes to Terms

We may update these terms from time to time. Material changes will be indicated by updating the “Last updated” date above. Continued purchases after changes constitutes acceptance.
